Re: Complaint against Special Prosecutors Cory Roberts, Kathryn Gregory and Sebastien Michaud

I wish to submit complaints regarding the above Crown Prosecutors as follows:

1. Sebastien Michaud has failed to appear at all three of my hearings so far - that is unacceptable. He is preventing me from getting answers to serious issues and avoiding answering to the fact he is prosecuting a charge with no evidence to support it.

2. Cory Roberts, Special Prosecutor, lied to the Court at my hearing on 16th February, 2015, when he said I was provided all disclosure. There are many documents mentioned in the Police/Crown case that have been concealed.

3. Kathryn Gregory (who was known as Kathryn El-Khoury) appeared at my hearing on Monday in a direct conflict of interests. She and her father both worked with the presiding Judge Julian Dickson's wife, in their law firm Athey, Gregory Dickson. They are clearly in a close relationship, that leads a reasonable person to believe they are friends, and gives the appearance that justice cannot be seen to be done if she represents the Crown against me and Dickson is the judge.

4. Ms. Gregory lied on the Court record twice at the last hearing of my prosecution, Monday 2nd March, 2015, when she falsely stated I had all the disclosure and I was using delay tactics. The first hearing confirmed I was entitled to more disclosure - which I have not yet received - and the second hearing was during a snow storm when even the judge did not turn up, but I did.

I require an investigation into this and an explanation from you for Crown Prosecutors lying in my hearings. Merci Charles LeBlanc

I realize this might look like someone who knows he's guilty and I'm just pulling any stunts of not having to go to Trial.

But I promise you this is not the case.

I know I'm not Guilty and that's the way it is!!!

What really bothers me is this Racist Special team of Cory Roberts, Sebastien Michaud and Kathryn Gregory want to convict me without a per trial. You know a little hearing to find out if there's enough evidence.

This so-called legal team and Provincial Judge Julian Dickson met in a room the last day that the limitation date would have been done. They refuse to tell me who was in that room?

This China style of Justice should not be allowed!!

To make matter worst they told me that I had no right to a lawyer. How many other people from the less fortunate population have this happen to????

Yes....I must educate the public with a protest in front of the Attorney General Office of this Racist Special Team!!!

Maybe the Liberal Government are behind this??? Who knows? But I will be confronting the Liberal MLA'S during the next few weeks on this issues. Racism must be confronted and destroyed!!!!

Yesterday, I asked Judge Julian Dickson if he signed the papers on the last day of the 6 months limitation that I be charge with assault???

At first, he said - No!!!

But he quickly changed his mind seconds later after viewing the paper I showed him in Court.

To have a Judge signing those papers without having all the evidence in front of him is VERY scary and this is the reason that I'm fighting this so-called charge./

I asked the Judge - Who was in the room when you signed these papers???

In a arrogant manner he answered - I don't have to tell you!!!!

This is the problem. The Fredericton Police and the people at the Justice Building are working together to charge certain people. < ESPECIALLY THE LESS FORTUNATE WITH MENTAL ISSUES >

This style of China Justice System SHOULD NOT be allowed in Canada!!!!

I didn't do good yesterday because I was confused. This was my 3rd hearing and there was three different Prosecutors and Judges.

They are calling themselves - The New Brunswick Special Prosecutors and I don't get it!!!!

What am I???? Some kind of Drug Lord????

I wanted to read a few concerns for the Court Record but I was distracted by the change of avenues and this was my 3rd different Judge.

Of course, Julian Dickson is the Judge who sent me to Jail for 2 days because I refuse to sign a tricky condition not to travel across the Westmorland Bridge.

He's the same Judge who told Panhandler Mike Gaudet to leave the City by Noon or he would be jailed!!!

The poor panhandler have lived in this City since 1989!!!!

Weeks later, Mike Gaudet was jailed because he came back to the City.

Here in this City they intimidate people with mental illness in the Court room. A cop sits out front and stares at you!!!! I was distracted yesterday and asked the Judge if the Cop could sit behind me because I just haven't been the same since they raided my place and told my internet Provider that I was having Sex with kids????

But he never told me there was any penalties because if there wasn't??? I was going to the R.C.M.P. the next day and lay complaints of Drug Dealing, Sexual assault and other charges against 7 members of the Fredericton Police Force.

We have a crooked Cop who accused people of having Sex with Kids and if the accuse fights back? He uses his race and cries racism!!!!

BULLSHIT!!!!

I would lay the complaints and if they are are proven not to be true? So what? Nothing can be done to me!!!

This is EXACTLY what's going on in this case.

As the only witness who saw everything told me - Charles? Why are you talking about this? Why are you concern??? You didn't do anything wrong!!! He came after you and he touched you first!!!!

Yes...I am thankful on two issues. He came after me SCREAMING like a lunatic and he took a swing at me first.

So why am I upset???? Because I CANNOT believe the Judge and this Special Force of Prosecutors are going after me without providing the whole evidence in this case.

I am going to forward a complaint against New Brunswick Provincial Judge Julian Dickson because he's working with someone in the back room and refuse to tell me who told him this one sided story.

You see...they say it's a summary assault therefore you don't have the right to a Lawyer and we don't have to provide you all the disclosures.

My God? The Cop who was in the room threatening the only witness in this case was Fredericton Police Officer Bobbi Simmons-Beauchamp!

Who is she? She's the one who told my Internet Provider that I was a pedophile!!!

As I told the Court....the Cops never made a proper investigation and if this happened to me? What other people is this happening to????

The Judge told me that I SHOULDN'T be concern of other people!!!! I should worry about me!!!

My disclosures hearing is in May and my trail will be in July!!!

I must stay calm. I am VERY angry that the system is not working for the less fortunate. The system is crooked and something MUST BE done with the matter they go after the less fortunate in this City!

I am during the next few months going to confront our politicians on this issue and listen their views.

Maybe the Liberal Government is behind this? Who knows? But I must stay calm but it's so difficult to do when you're Scottish...:(

A blogger with a history of butting heads with the Fredericton Police Force and the courts refused Monday to enter a plea to an assault charge.

Charles Joseph LeBlanc, 55, of 1-145 Westmorland St. faces a charge of assault, alleging an offence against Andrew Spencer.

Monday marked LeBlanc’s third appearance on the charge. The defendant told the court he again wasn’t prepared to enter a plea.

“Because we haven’t got full disclosure,” LeBlanc told the court.

“There’s so many unanswered questions.”

Crown prosecutor Kathryn Gregory, appearing on behalf of prosecutor Sebastien Michaud, who will handle the prosecution, reiterated the Crown’s position that full disclosure had been made.

LeBlanc complained that Michaud, who’s based in Edmundston, again hadn’t appeared in court. He said he’d sent Michaud a letter detailing the further disclosure he was seeking.

Judge Julian Dickson viewed the letter.

LeBlanc also demanded a preliminary hearing, but the judge explained he wasn’t entitled to one, as the charge alleges a summary offence.

Dickson said if the charge were indictable, which is more serious, LeBlanc could opt for a trial at a higher level of court, preceded by a preliminary hearing.

Gregory argued the case needed to move forward and that the time had come for LeBlanc to enter a plea and to set a trial date.

She said if he didn’t, the Criminal Code of Canada authorized the court to enter a not-guilty plea on his behalf.

Dickson agreed.


Earlier in Monday’s court proceedings, he said the case against him was built on lies and that he was “100 per cent not guilty.”

The judge entered a not-guilty plea on LeBlanc’s behalf.

Dickson asked Gregory how long would be needed for trial, to which the prosecutor said a day would suffice.

“I say a week,” LeBlanc said.

Dickson said the court will start with setting it down for a day and determine if further trial time is necessary after that.

The judge also scheduled a hearing on the disclosure issue for May 7.

LeBlanc also wanted to know who would be presiding over the trial, and Dickson said it hasn’t been determined which judge will hear the case.

LeBlanc argued that he needed to be know because he didn’t want Dickson handling the trial.

“I put a complaint against you in the past,” he said.

Dickson noted that complaint was dismissed but told LeBlanc he could file a motion for him to recuse himself.

While the assault charge alleges an incident in Fredericton on July 3, the Miramichi Police Force handled the investigation and laid the charge.

The Fredericton force asked its Miramichi counterpart to handle the case given LeBlanc’s contentious history with Fredericton police officers.

Fredericton’s best-known activist blogger is on the hunt for evidence that would prove his allegation that the Fredericton Police Force influenced or interfered with his assault investigation. Charles Joseph LeBlanc, 55, of 1-145 Westmorland St. made his first appearance Monday in provincial court to answer to a count of summary assault, alleging an incident involving complainant Andrew Spencer in downtown Fredericton on July 3.

LeBlanc was joined by a handful of supporters in the courtroom. Though the incident leading to the charge occurred in Fredericton, the matter was investigated by the Miramichi Police Force, which also laid the charge in Fredericton provincial court.

The Fredericton Police Force farmed the case out to the outside agency because it has a tumultuous history with LeBlanc. The controversial blogger told Judge Brian McLean on Monday morning he wasn’t prepared to enter a plea and that he had some questions.

He first asked on the record if the disclosure package he’d already received from the Crown was complete and if the documents represented true copies of the evidence and reports. Prosecutor Cory Roberts confirmed that was the case. Then LeBlanc asked for copies of all emails between the Fredericton Police Force and its Miramichi counterpart in the case. Roberts said LeBlanc could ask the Crown prosecutors’ office and someone could look into the issue to see if there was anything available on that point. McLean adjourned the case to Feb. 16 for plea. “This has Fredericton police all over it,” LeBlanc told reporters outside the Justice Building on Monday following his court appearance.

The Fredericton Police Force declined to comment on the allegation Monday. “Given the difficult and public relationship between Mr. LeBlanc and the Fredericton Police Force, at [police Chief Leanne Fitch’s] request, an outside agency was sought to assess and investigate the complaint,” spokeswoman Alycia Morehouse wrote in an email. “Miramichi police agreed to do it, therefore any questions pertaining to the investigation must be directed to them.” Sgt. Jody Whyte of the Miramichi Police Force said the Fredericton force had nothing to do with the assault probe. “It was investigated by our agency,” he said.

To his knowledge, Whyte said, the Fredericton police’s only involvement in the file would have been to request the Miramichi police to conduct the investigation, to receive a heads-up about the results of the investigation and for a Fredericton officer to give a fellow officer from Miramichi a ride to LeBlanc’s home to serve him a summons for court.

LeBlanc has protested the city police force’s enforcement of cycling bylaws, suggested online the force is harbouring pedophiles and steroid users among its membership, and has alleged harassment. The blogger points to his video-recording of a rough arrest effected by a member of the Fredericton force that was ultimately used as evidence against the officer in an assault trial. That officer was acquitted, but LeBlanc points to that situation as the trigger for a campaign by the force to get back at him. Members of the city police also raided his apartment three years ago and arrested him as part of a criminal libel investigation that alleged LeBlanc had unjustly smeared another one of its officers.

The case was scuttled when the Crown declined to prosecute, noting constitutional issues had arisen in other jurisdictions with that particular section of the Criminal Code of Canada. LeBlanc learned last year that a document filed with his Internet service provider as part of that libel investigation referred to a child sex exploitation investigation.

The police force has explained it was a clerical error, as the document used in the case is typically filed with ISPs to get evidence in child-pornography cases, not libel matters. LeBlanc has rejected that explanation, alleging the force was purposefully trying to label him a pedophile. In turn, he started suggesting on his blog that several members of the city police were pedophiles.

A complaint from City of Fredericton chief administrative officer Chris MacPherson to the free hosting service owned by Google about those comments led Google to take the blog down in its entirety last year.

LeBlanc has alleged the city has violated his right to free speech. He has since launched a new blog on the same free hosting service, on which he has alleged that while the Miramichi police investigated the new assault complaint, the Fredericton Police Force has had its hands all over the case as part of its alleged vendetta against him. “This is a waste of taxpayers’ money,” the blogger told reporters Monday. LeBlanc told the court he hadn’t consulted with duty counsel Monday morning, and he told reporters later he didn’t know if he’d apply for legal aid.

He also noted in court his first court appearance on the Spencer assault complaint was three years to the day Fredericton police raided his apartment for the libel investigation. The blogger also pointed out the new assault charge was laid the day before the limitation for the summary charge would have run out. With a summary assault matter, police have six months from the time of the allegation to file a charge.

LeBlanc told reporters the police didn’t conduct a full investigation and didn’t ask him for his side of the story. However, he then admitted the Miramichi police did contact him for a statement, offering to meet with him either at the Fredericton police station or to drive him up to the Miramichi and back. “I didn’t feel comfortable,” he told reporters, noting he’d rather give a statement over a cup of coffee instead of in a police interview room on video.

Because it shows just how close to the government the Irving media really is-although its not like people didn't know that. But this issue is also the fact that an attempt was made to remove the journalists name from the register, and a denial was made that it occurred. It also shows just how lousy the media is in New Brunswick that the story is 'broke' from some website nobody heard of. Mind you, given that Charles 'broke' the story that rooming house tenants had no housing rights in New Brunswick, then that also isn't really news to anybody paying attention. But the fact is that lots of people DON"T pay attention.

Its also something of a travesty that the New Brunswick government even HAS a secret fishing lodge where it 'entertains' all manner of people. What, a hotel isn't good enough for them? Whats going on that they have to meet out in the woods under police protection? Combine that with the other fact that New Brunswick 'auctions' off pieces of rivers, something that is also illegal in every other province (technically you can't 'own' a waterway), and it shows just how much of a banana republic the province really is. That the crown has nothing better to do than prosecute an 'assault' with no actual witnesses also pretty much proves that as well. So somebody following Charles blog may very well think "hey, compared to most of the s&&& that goes on, who cares about who stays at a lodge?" But again, lots of people don't follow the blog, so this is pretty newsworthy.

Thanks to the article at Canadaland we are also reminded that a former Brunswick news official is now a high ranking official for Brian Gallant, showing that the more things change in NB, the more they stay the same.
